Publishing Agreement - the simple solution!This agreement is between you ("the Author") and Dragonpublishing.net ("Dragonpublishing.net" or "publisher"), for your book ("Work").
All copies of work will contain a copyright notice in the name of the author.
The Author represents: That he/she is sole owner of Work. That he/she has not assigned or pledged the rights to Work. That he/she has full power to enter into this Agreement. That the Work and rights are free of liens, claims or interest. That the Work is original. That the Work does not violate any personal or proprietary rights. That the Work is not libelous or obscene. That information contained in Work is accurate and not injurious to the reader or any other party.
The Author acknowledges and agrees that Dragonpublishing.net acquires no right of ownership to the Work; that Dragonpublishing.net is a provider of limited services only and assumes no responsibility for reviewing or correcting the content of the Work.
Your paperback and hardcover royalties are 83% of the payments received by Publisher from sales of your book. These payments are equal to the cover price less trade (wholesale) discount, less the single-copy printing cost (this is the profit margin of the transaction). Royalties are distributed quarterly. No royalty will be paid on author purchases.
Example: Someone purchases a copy of your 210 page book at Barnes & Nobles and the cover price of your book is $14.50. Subtract Barnes & Nobles 55% trade discount ($7.98) and subtract the printing cost ($4.05), the remainder ($2.47) is the profit margin, 83% of which ($2.05) is the royalty paid to you.
Authors may purchase copies of their own title, in any quantity from Dragonpublishing.net, at the current printing cost plus 10%, plus the actual shipping and handling.
Note: Printing prices are subject to change as market conditions and costs warrant.
Dragonpublishing.net prices books based on finished page count, however, we will consider special pricing requests whenever possible and if we feel the book is still within market value.

The Author agrees to indemnify, defend and hold harmless Dragonpublishing.net, its employees, directors, representatives, successors and assigns of, from any and all manner of claims, liabilities, damages, losses, expenses (including attorney's fees), awards, and judgments resulting from claims of third parties regarding ownership, libel, slander, plagiarism, privacy violations, copyright infringement, misappropriation, and similar claims arising from publication of the Work. Dragonpublishing.net may be represented in any proceeding by counsel of its choice; the Author may retain additional counsel at his or her own expense.
If the copyright of the Work is infringed and the parties (Author and Publisher) proceed jointly, the expenses and recoveries, if any, will be shared equally, and if they do not proceed jointly, either party will have the right to prosecute, and such party will bear the expenses thereof, and any recoveries will belong to such party.
This Agreement is nonexclusive, the Author retains the copyright for this Work and may enter into other publishing agreements. Either the Author or the Publisher may terminate the Agreement at any time, with or without cause. If the Agreement is terminated by the Author prior to publication, publishing fees less any fees for pre or post publication services such as page layout or any add-on service already fulfilled, will be refunded (or applied against any outstanding amounts in the Author's account.) If the Agreement is terminated by Dragonpublishing.net, all publishing fees will be refunded in full (or applied against any outstanding amounts in the Author's account). Publication fees are defined as those fee's directly associated with disk and/or paper manuscript submission. Fees related to other pre or post publication services, such as data entry, corrections, cover design, image processing, or book sales, are not refundable. Fees for the publication of subsequent editions of the Work are not refundable. If the Agreement is terminated by Dragonpublishing.net due to a breach of Agreement by Author, no fees shall be refunded.
All notices to Dagonpublishing.net must be sent in writing to its office at 635 S. Cross, Sycamore, IL 60178. All notices to the Author shall be in writing to the address specified by the Author.
This Agreement constitutes the entire agreement between Author and Publisher with respect to the matters covered by it, and supersedes any prior understanding or agreements, oral or written, with respect thereto. The parties will not be bound by any understanding, agreement, promise, or representation, whether or expressed or implied, which is not specified in this Agreement. This Agreement may not be modified or amended except in writing signed by the party against whom such modification or amendment is sought to be enforced.
The laws of the State of Illinois will govern this Agreement. Any dispute or controversy arising under, out of, in connection with, or in relation to this Agreement, and any amendments thereof, will be determined and settled by arbitration in accordance with the rules of the American Arbitration Association, provided that the Arbitrator shall have no authority to award punitive damages. Venue for any arbitration will be in Dekalb County, Illinois. Notwithstanding the foregoing, nothing in this Agreement shall be deemed to deprive a party of the right to equitable relief in a court of competent jurisdiction respecting rights to its intellectual property or use thereof under this Agreement. In the event that ay matter is submitted to arbitration pursuant to this paragraph, the prevailing party will be awarded its costs and reasonable attorney fees, including costs and reasonable attorney's fees associated with collection.
